About Nyaya Nishtha Anti Harassment Panel

Recognising this harsh reality, Nyaya Nishtha established the Anti Harassment Panel — a legal and social initiative designed to protect individuals from unlawful recovery practices and ensure that the rule of law prevails over harassment and coercion.


The Purpose Behind the Initiative

The Nyaya Nishtha Anti Harassment Panel was founded with one clear objective:

While debt recovery is a legitimate process, it must be conducted strictly within the boundaries of law. Unfortunately, recovery agents often use fear, verbal abuse, and public shaming to extract repayments. Such actions are not only unethical but constitute offences under the Bharatiya Nyaya Sanhita (BNS), 2023.


Legal Framework and Rights of Citizens

The panel operates strictly in accordance with Indian laws, ensuring that no person is subjected to unlawful harassment. The relevant legal provisions include:

  • Article 21 of the Constitution of India – guarantees the Right to Life and Personal Liberty, which includes the right to live with dignity and without harassment.

  • RBI Guidelines on Fair Practices Code – prohibit banks and recovery agencies from using intimidation, coercion, or public humiliation for loan recovery.

  • Consumer Protection Act, 2019 – protects borrowers from unfair trade practices and deficiency of services by financial institutions.

Bharatiya Nyaya Sanhita (BNS), 2023 –

  • Section 351 – Punishes criminal intimidation and threats.

  • Section 352 – Penalises intentional insult with intent to provoke breach of peace.

  • Section 126 – Wrongful restraint

  • Section 308  – Covers extortion and coercive methods used to obtain property or repayment.

These provisions collectively ensure that no recovery process can bypass the law or infringe upon a citizen’s dignity and legal right.

The Nyaya Nishtha Anti Harassment Panel is a coalition of advocates, counsellors, and social workers committed to timely intervention and awareness. It provides:

  1. Legal Representation & Advisory: Helping victims take legal action against unlawful recovery methods and help in Settlement of their loan

  2. Preventive Intervention: The panel directly communicates with banks or agencies to settle the matter amicably and  ensure lawful conduct during recovery.

  3. Complaint Assistance: Drafting and filing formal complaints before the Police, RBI Ombudsman, or Consumer Commissions.

  4. Psychological & Emotional Support: Providing counselling for individuals facing mental distress due to financial harassment.
